1. Acceptance of Terms
These Terms of Service (“Terms”) govern the use of the Rentistic software-as-a-service platform (“Service”), provided by TRAVEL SOFT d.o.o., Vukovarska 156, 21000 Split, Croatia, OIB: 02023934203 (“Rentistic”, “Service Provider”, “we”).
By registering for, accessing, or using the Service, the user (“User”) confirms that they have read, understood, and accepted these Terms in full.
2. Description of the Service
Rentistic is a cloud-based SaaS platform intended for managing accommodation facilities, including reservations, pricing, availability, reporting, and related business processes.
The Service Provider reserves the right to modify, improve, or discontinue any part of the Service at any time.
3. Eligibility and Account Registration
The Service may be used by natural or legal persons with legal capacity.
The User is responsible for providing accurate, complete, and up-to-date information and for maintaining the confidentiality of account credentials.
All activities performed through the User’s account shall be deemed performed by the User.
4. Free Trial
Rentistic may offer a free trial period of fourteen (14) days.
During the free trial, the Service is provided without charge and without obligation to subscribe.
The Service Provider reserves the right to limit functionality or terminate the free trial in cases of misuse or violation of these Terms.
Upon expiration of the free trial, access to the Service will cease unless a subscription is agreed.
5. Subscriptions, Fees, and Payment
The Service is provided based on monthly subscription plans, which may be fixed or calculated as a percentage of the User’s generated revenue, as agreed between the parties.
Fees are invoiced manually, and payment must be made within the deadline stated on the invoice.
All prices are exclusive of VAT unless otherwise stated.
Failure to pay due amounts entitles the Service Provider to suspend or terminate access to the Service.
6. Third-Party Integrations
The Service may allow integrations with third-party services.
Such integrations are activated solely at the User’s request.
Rentistic is not responsible for the availability, functionality, security, or data processing practices of third-party services.
Use of third-party services is subject to the terms and policies of those providers.
7. User Obligations and Acceptable Use
The User shall use the Service in compliance with applicable laws and these Terms.
The User shall not misuse the Service, interfere with its operation, introduce unlawful content, or attempt to reverse engineer or reproduce the software.
The User is solely responsible for the data and content entered into the Service.
8. Data Ownership and Data Protection
All data entered into the Service by the User remains the property of the User.
The Service Provider processes personal data solely for the purpose of providing the Service, in accordance with the Privacy Policy and applicable data protection laws.
Upon termination, the Service Provider may delete User data after a reasonable retention period, unless otherwise required by law.
9. Intellectual Property
The Service and all related software, content, and documentation are the exclusive property of the Service Provider.
The User is granted a limited, non-exclusive, non-transferable, and revocable license to use the Service for internal business purposes only.
10. Availability and Disclaimer
The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
The Service Provider does not guarantee uninterrupted or error-free operation of the Service.
11. Limitation of Liability
The Service Provider shall not be liable for any direct or indirect, incidental, or consequential damages, including but not limited to loss of data, profits, business opportunities, or costs arising from the use or inability to use the Services.
12. Indemnification
The User agrees to indemnify and hold harmless the Service Provider from any claims, damages, or losses arising from unlawful use of the Service or violation of these Terms.
13. Termination and Suspension
The User may terminate use of the Service at any time, subject to settlement of outstanding obligations.
The Service Provider may suspend or terminate access if the User materially breaches these Terms.
14. Changes to the Terms
The Service Provider may amend these Terms from time to time. Continued use of the Service constitutes acceptance of the amended Terms.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Croatia.
The court in Split shall have exclusive jurisdiction.
